Courier Agreement
The standards and responsibilities that apply to independent couriers using Sendi in Kenya.
1. Independent courier status
You provide delivery services as an independent contractor and decide whether to accept available jobs. Nothing in this Agreement creates employment, partnership, agency or exclusivity between you and SENDI LTD.
You are responsible for your own taxes, statutory obligations, permits, equipment, mobile data, fuel, maintenance and insurance unless Sendi confirms otherwise in writing. You must not represent that you are authorised to bind Sendi.
2. Eligibility, verification and documents
You must be at least 18, legally entitled to work and provide services in Kenya, and supply accurate identity and contact information. You must complete Sendi's onboarding and any identity checks.
Where you use a motorcycle, car, van or other vehicle, you are responsible for holding a valid driving licence, vehicle registration, inspection, insurance, protective equipment and any permit required by Kenyan law. You must promptly tell Sendi if a document expires, is suspended or becomes inaccurate.
3. Accepting and performing jobs
Review the route, item information, size, weight, payment and special instructions before accepting. Only accept jobs you can perform safely, lawfully and within a reasonable time.
Once accepted, proceed without unnecessary delay, communicate material problems through the platform and do not abandon, transfer or subcontract a job without Sendi's approval.
You may refuse collection where the item is prohibited, unsafe, leaking, inadequately packaged, materially different from the booking or likely to exceed your lawful carrying capacity.
4. Care, custody and delivery standards
From authorised pickup until completed delivery or lawful return, take reasonable care of the item, keep it secure and protect it from avoidable damage, theft, contamination and weather.
Follow lawful customer instructions, but do not follow instructions that are unsafe, unlawful or inconsistent with the platform. Do not open packages unless necessary for immediate safety or required by law.
Use pickup codes and delivery PINs exactly as instructed. Do not request a code before the correct handover stage or enter false completion information.
5. Pickup, delivery and Safe Drop evidence
You must take clear, truthful photos where the platform requires them. Pickup photos should show the item and visible packaging condition. Safe Drop photos should show the item and enough location context to demonstrate where it was left, while avoiding unnecessary images of people or private interiors.
Do not reuse old photos, obscure damage, edit evidence to mislead, upload unrelated images or complete a job away from the required location. Evidence may be reviewed by Sendi, customers, insurers, advisers, regulators or law-enforcement bodies where lawful.
6. Road safety and lawful operation
You must obey Kenyan traffic laws, speed limits, helmet and protective-equipment requirements, vehicle-capacity rules and lawful directions from authorities. Never interact with the app in a way that makes driving or riding unsafe.
You must not perform jobs while impaired by alcohol, drugs, illness, fatigue or any condition that makes safe delivery unlikely. You are responsible for choosing a safe route and parking or stopping lawfully.
7. Earnings, fees and payouts
The amount displayed for an accepted job is subject to successful completion, platform fees, lawful deductions, refunds, fraud checks and any adjustment clearly disclosed by Sendi.
Payouts may be made through M-PESA, bank transfer or another supported provider. You must provide accurate payout details and are responsible for charges or delays caused by incorrect information or third-party payment systems.
You must not demand unauthorised cash, ask customers to pay off-platform or manipulate a route, status, GPS event or evidence record to increase payment.
8. Damage, loss, accidents and incidents
Report visible damage, a leaking or unsafe package, road accident, theft, loss, threat, injury or other material incident promptly through Sendi. Provide an accurate description and clear photos where requested.
Reporting damage does not by itself cancel the job. Follow Sendi's instructions and do not continue where doing so would be unsafe or unlawful. In an emergency, first contact the appropriate Kenyan emergency or law-enforcement service.
9. Customer information and confidentiality
Use customer, recipient and address information only to perform the job. Do not copy, publish, sell, retain or use it for personal marketing or contact after the job except where reasonably necessary to resolve an active delivery issue.
Protect your device and account, keep one-time codes confidential and promptly report suspected unauthorised access or data loss.
10. Complaints, suspension and termination
Sendi may investigate complaints and review GPS, messages, evidence and account records. We may restrict access during an investigation where reasonably necessary for safety, fraud prevention or legal compliance.
Serious or repeated breaches, unsafe conduct, fraud, false evidence, theft, harassment, expired documents or unlawful activity may lead to suspension or termination and referral to insurers, regulators or law-enforcement authorities.
11. Kenyan law and contact
